Article 1. Use of the service

1.1. OnlineQuiz.nl offers ready-made quizzes that are immediately available digitally after purchase. You decide how and for what purposes you use the quiz.
1.2. To purchase a quiz, select a quiz and pay via iDEAL, Bancontact, Google Pay, Apple Pay, KBC, Visa or Mastercard. Our quizzes are created in ClassicQuiz. After payment, you will immediately receive the login details to play the quiz through ClassicQuiz. Read more about the partnership between OnlineQuiz and ClassicQuiz here.
1.3. The quiz can be played for 30 days after purchase. Should you experience any problems playing the quiz, please contact OnlineQuiz.nl.
1.4. Personal data will be processed when using OnlineQuiz.nl. You consent to all forms of processing within the scope of the service. Please refer to OnlineQuiz’s privacy statement for more information.

Article 2. Rules of use

2.1. It is prohibited to use OnlineQuiz.nl for activities that violate Dutch laws and regulations, such as storing or distributing unlawful, defamatory, or racist content.
2.2. OnlineQuiz.nl reserves the right to take action in the event of violations of these rules of use and may take appropriate measures to stop misuse.
2.3. If your actions cause damage to OnlineQuiz.nl or third parties (for example, through excessive data traffic, viruses, or data breaches), OnlineQuiz.nl may take measures such as restricting or terminating your access.
2.4. OnlineQuiz.nl may report criminal offenses to the authorities.
2.5. You indemnify OnlineQuiz.nl against any third-party claims resulting from violations of these rules of use.

Article 3. Availability and maintenance

3.1. OnlineQuiz.nl strives for continuous availability of the service, but does not guarantee uninterrupted access.
3.2. Maintenance may result in temporary restrictions in availability. Planned maintenance will be announced in advance as much as possible.
3.3. OnlineQuiz.nl reserves the right to modify and improve the functionality of the service, where feedback from users is welcome, but OnlineQuiz.nl will decide which modifications are made.

Article 4. Intellectual Property

4.1. All content, software and materials on OnlineQuiz.nl are the intellectual property of OnlineQuiz and may not be copied or reused without written permission, except as permitted by law.
4.2. If you provide feedback on the Service, you grant OnlineQuiz an unlimited and perpetual right of use to use this information to improve the Service.
4.3. OnlineQuiz.nl will not take cognizance of stored data unless necessary for the provision of the service or required by law.

Statutory right of withdrawal

Upon delivery of products:

  1. When purchasing products, the consumer has the option to terminate the agreement without giving reasons within 14 days. This cooling-off period commences on the day after the product is received by the consumer or a representative designated in advance by the consumer and announced to the trader.
  2. During the cooling-off period, the consumer shall handle the product and packaging with care. He shall only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If they exercise their right of withdrawal, they shall return the product to the trader with all accessories supplied and, if reasonably possible, in its original condition and packaging, in accordance with the reasonable and clear instructions provided by the trader.
  3. If the consumer wishes to exercise his right of withdrawal, he is obliged to notify the trader within 14 days of receiving the product. The consumer must notify the trader using the model form or by other means of communication, such as email. After the consumer has notified the trader of their intention to exercise their right of withdrawal, the customer must return the product within 14 days. The consumer must prove that the goods have been returned in time, for example by means of proof of shipment.
  4. If, after the expiry of the periods referred to in paragraphs 2 and 3, the customer has not indicated that he wishes to exercise his right of withdrawal or has not returned the product to the trader, the purchase is final.

Upon delivery of services:

  1. When services are provided, the consumer has the option to terminate the agreement without giving reasons for at least 14 days, starting on the day the agreement is entered into.
  2. In order to exercise his right of withdrawal, the consumer shall follow the reasonable and clear instructions provided by the trader in the offer and/or at the latest upon delivery.

Costs in the event of withdrawal

  1. The consumer shall bear the direct costs of returning the product.
  2. If the consumer has paid an amount, the trader will refund this amount as soon as possible, but no later than 14 days after cancellation. This is subject to the condition that the product has already been received by the online retailer or that conclusive proof of complete return can be provided. Refunds will be made using the same payment method used by the consumer, unless the consumer expressly agrees to a different payment method.
  3. In the event of damage to the product due to careless handling by the consumer, the consumer shall be liable for any reduction in the value of the product.
  4. The consumer cannot be held liable for any reduction in the value of the product if the trader has not provided all the legally required information about the right of withdrawal; this must be done before the purchase agreement is concluded.

Exclusion of right of withdrawal

  1. The trader may exclude the consumer’s right of withdrawal for products as described in paragraphs 2 and 3. The exclusion of the right of withdrawal only applies if the trader has clearly stated this in the offer, at least in good time before the conclusion of the contract.
  2. Exclusion of the right of withdrawal is only possible for products:
    • which have been made by the entrepreneur in accordance with the consumer’s specifications;
    • which are clearly personal in nature;
    • which, by their nature, cannot be returned;
    • which can spoil or become obsolete quickly;
    • whose price is subject to fluctuations in the financial market over which the entrepreneur has no influence;
    • for individual newspapers and magazines;
    • for audio and video recordings and computer software where the consumer has broken the seal;
    • for hygiene products where the consumer has broken the seal.
  3. Exclusion of the right of withdrawal is only possible for services:
    • relating to accommodation, transport, restaurant services or leisure activities to be performed on a specific date or during a specific period;
    • the delivery of which has commenced with the consumer’s express consent before the cooling-off period has expired;
    • relating to betting and lotteries.

Depreciation: If the product is damaged or the packaging is damaged more than is necessary to try the product, we may charge you for this depreciation of the product. Therefore, please handle the product with care and ensure that it is properly packaged when returning it.

Article 5. Compensation and payment

5.1. Fees are charged for the use of OnlineQuiz.nl. The current prices can be found on the website.
5.2. Payment is made via iDEAL, Apple Pay, Google Pay, Bancontact, KBC or credit card (Visa/Mastercard).
5.3. Since the quiz is available immediately after purchase, revocation or refund is not possible based on the Distance Selling Act (Article 6:230p of the Dutch Civil Code).

Article 6. Liability

6.1. OnlineQuiz shall not be liable for any damages resulting from use of the service, except for willful misconduct or gross negligence. The maximum liability is limited to the amount you paid in the three months preceding the damage.
6.2. OnlineQuiz shall not be liable for indirect damages, such as lost profits or lost savings.
6.3. Complaints about damages must be reported in writing no later than two months after discovery.
6.4. OnlineQuiz is not liable for disruptions to external services such as ClassicQuiz, YouTube or other platforms that may be used when playing the quiz.
6.5. If you use music with the quiz, you are responsible for obtaining the appropriate music rights. OnlineQuiz is not liable for this.

Complaints procedure

In the event of complaints, consumers should first contact the trader. If the online shop is affiliated with WebwinkelKeur and complaints cannot be resolved by mutual agreement, consumers should contact WebwinkelKeur (www.webwinkelkeur.nl), , which will mediate free of charge. Check whether this online shop has a current membership via https://www.webwinkelkeur.nl/leden/. If a solution cannot be reached, the consumer has the option of having their complaint handled by the independent disputes committee appointed by WebwinkelKeur. The decision of this committee is binding, and both the trader and the consumer agree to this binding decision. Submitting a dispute to this disputes committee entails costs that must be paid by the consumer to the committee in question.

Article 7. Duration and termination

7.1. This agreement is effective from your initial use and shall remain in effect for as long as you use the service.
7.2. If desired, OnlineQuiz may provide a copy of your stored data for an additional charge.

Article 8. Fair Use Policy.

8.1. Use of OnlineQuiz.nl is subject to a fair use policy. If your usage is excessive compared to average usage, OnlineQuiz may hold you accountable.
8.2. In the event of persistent excessive use, OnlineQuiz may take action, such as restricting your access.

Article 9. Changes to terms and conditions

9.1. OnlineQuiz reserves the right to change the terms and conditions and prices.
9.2. If you do not agree to the changes, you may terminate the agreement before the effective date. Continued use after the effective date constitutes acceptance of the changes.

Article 10. Other provisions

10.1. This agreement is governed by Dutch law.
10.2. Disputes will be submitted to the competent Dutch court in the district where OnlineQuiz is located.
10.3. Written communication includes e-mail and messages via the service, provided that the origin and integrity are guaranteed.
10.4. If any provision of these terms and conditions is found to be invalid, the remaining provisions shall remain in effect.
10.5. OnlineQuiz may transfer its rights and obligations under this agreement to a third party who takes over the activities of OnlineQuiz.nl.
10.6. In case of conflict between a foreign language version and this Dutch version, the Dutch version shall prevail.
